Copyright & Intellectual Property Policy

BACKEND Booking LLC respects intellectual property rights and expects users to do the same. This policy covers ownership of work created through the Service and how to report infringement.

1. Ownership of user content

You keep ownership of the profile content, portfolio work, and media you upload. By uploading, you grant us the limited license described in Section 11 of the Terms of Service so we can host and display it. Only upload work you created or have permission to use, including any model, property, or music releases required.

2. Ownership of delivered work

Ownership of work delivered under a booking is determined by the written agreement between the Customer and the Creator, recorded in the booking or in messages. Absent a written agreement, the Creator retains copyright and grants the Customer a non-exclusive, worldwide license to use the deliverables for the purpose described in the booking. Exclusive rights, buyouts, work-for-hire, resale rights, and extended commercial or advertising usage must be agreed in writing and are typically priced separately.

3. Portfolio and promotional use

Unless the parties agree otherwise in writing, a Creator may display delivered work in their portfolio and marketing, and a Customer may display the work in the agreed usage context. Either party may request confidentiality before work begins.

4. Licensing terms to define in every booking

  • Who owns the copyright and any raw files or project files.
  • Where the work may be used (web, print, paid advertising, broadcast).
  • For how long, and in which territories.
  • Whether the license is exclusive, and whether credit is required.
  • Whether resale, sublicensing, or AI training use is permitted.

5. Trademarks

"BACKEND Booking", the BACKEND Booking logo, and related marks are owned by BACKEND Booking LLC. Do not use them in a way that implies endorsement, affiliation, or partnership without written permission.

6. DMCA takedown notices

If you believe content on the Service infringes your copyright, send a written notice to our designated agent containing all of the following:

  • Your physical or electronic signature (or that of an authorized agent).
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the infringing material and its exact URL or location.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.

We generally review notices within 2 business days, remove or disable access to material that is the subject of a valid notice, and notify the affected user.

7. Counter-notices

If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice containing: your signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification; your name, address, and phone number; consent to the jurisdiction of the federal court in the State of Delaware, USA; and consent to accept service of process from the complaining party. We may restore the material in 10–14 business days unless the complainant files a court action.

8. Repeat infringers

We terminate the accounts of users who are repeat infringers. Knowingly filing a false notice or counter-notice may expose you to liability for damages under 17 U.S.C. § 512(f).
