Creator Agreement

This Creator Agreement applies to every user who lists services, accepts bookings, applies to opportunities, or receives payouts on BACKEND Booking. It supplements the Terms of Service.

1. Independent contractor status

You are an independent contractor. Nothing here creates an employment, agency, partnership, or joint-venture relationship with BACKEND Booking LLC. You control how, when, and where you perform your services, you may work through other channels, and you supply your own equipment. You are not entitled to employee benefits, and you are responsible for your own insurance, licenses, and permits.

2. Listing your services

Listings must accurately describe what you deliver, your experience, your turnaround, and your full price. No bait pricing, no undisclosed surcharges added after booking, and no portfolio work you did not create. Keep availability current — accepting bookings you cannot honor damages your standing.

3. Accepting and delivering bookings

Respond to requests promptly. Once you accept a booking or an offer is accepted and paid, you are contractually committed to the agreed scope, schedule, and deliverables. Deliver on time, communicate proactively about any change, and mark the booking complete when finished. All scope or price changes must be agreed in writing inside the Service.

4. Payouts

Payouts are made through Stripe Connect. You must complete Stripe onboarding — including identity, business, and bank details — before you can accept paid bookings or receive funds, and you agree to the Stripe Connected Account Agreement. Funds are released from escrow after completion and the review window, net of the platform fee (currently 10%) and processing fees. Payout timing depends on Stripe and your bank. Stripe may pause payouts pending verification or risk review.

5. Taxes

You are solely responsible for reporting and paying all income, self-employment, sales, and VAT taxes on your earnings. Stripe issues applicable tax forms (such as US Form 1099-K) where thresholds are met. You must provide accurate tax information; we may withhold payouts until required documentation is supplied.

6. Cancellations and refunds

Cancelling a confirmed booking triggers a full refund to the Customer and may affect your ranking and standing. Refunds, disputes, and chargebacks are handled under the Refund & Cancellation Policy. If a payout is reversed, you authorize us to offset the amount against future payouts or to invoice you.

7. Intellectual property in your work

You retain copyright in your work unless you agree otherwise in writing. Define usage, exclusivity, territory, duration, and credit in the booking before you start. See the Copyright & IP Policy. You warrant that your deliverables do not infringe anyone's rights and that you hold any required releases.

8. Professional conduct

Show up on time and prepared, behave professionally on set and on location, respect the privacy and boundaries of everyone present, and follow all applicable safety and legal requirements. Do not subcontract without the Customer's written consent; if you do, you remain fully responsible for the work.

9. No off-platform circumvention

All work sourced through BACKEND Booking must be booked and paid through BACKEND Booking for at least 12 months after first contact. Soliciting off-platform payment is a material breach and may result in termination and forfeiture of pending payouts.

10. Insurance and liability

You are responsible for maintaining any insurance appropriate to your work (general liability, equipment, professional indemnity). You are liable for loss, injury, or damage caused by your services, and you indemnify BACKEND Booking LLC against claims arising from them.

11. Standing, ranking, and account status

Response time, completion rate, cancellation rate, review scores, verification status, and report history determine your discovery ranking and can trigger warnings, feature limits, payout holds, suspension, or removal.

12. Termination

You may stop offering services or close your account at any time, but you must complete or properly refund any booking already paid. We may terminate this Agreement under Section 13 of the Terms. Payout, tax, indemnity, and IP obligations survive.
